CM/ECF UPDATES EFFECTIVE NOVEMBER 11, 2011 -- COUNTY CODES BASED ON STATE GIVEN FOR DEBTOR'S MAILING ADDRESS
In CM/ECF Version 4.2, the counties available for selection when filing a new petition will be based on the state provided in the debtor's address. For example, if the debtor's address is Hershey, Pennsylvania, you will be presented with counties from Pennsylvania only. That is because the county code selected should always reflect the county of residence at the time of filing.
If the debtor's current residence is outside the counties of the Western District of New York, the Clerk's Office will assign the "County of Residence or of the Principal Place of Business" based on the voluntary petition. This is not a determination of proper venue; it is a ministerial action to ensure that CM/ECF reflects the county indicated on the voluntary petition so that the case will be assigned to the correct Division (Buffalo or Rochester).
