- Is CM/ECF mandatory in New York-Western Bankruptcy Court?
Electronic Filing became mandatory October 1, 2004, with very limited exceptions. The issuance of your login and password constitutes your agreement to file all documents electronically with the court from that point forward. There is no option to file some documents in paper and some electronically. Once you are an e-filer, you must file everything with just those few exceptions identified in the Administrative Procedures such as orders, transcripts, and sealed documents. However, until you have registered for ECF, you must continue to file conventionally. Please see the following Standing Order (Administrative Order No. 5). - When must I have my credit card information to the Court?
You may submit the Blanket Credit Card Authorization Form with your registration form. Please note that you may use any valid MasterCard, Visa, Discover, American Express or Diners Club card with a sufficient balance when paying via credit card over the internet for electronic filings. The Blanket Credit Card Authorization is for secondary use should an internet payment fail at the time of the transaction. - When do I agree to E-Service?
As an ECF user, you agree to electronic service when you receive your login and password for ECF-live. You will receive service in cases to which you are a party. You will not receive electronic notice in all cases in the ECF database. - When paying by credit card over the internet, do I have to use the card and account number on file with the Court?
No. You may use any valid MasterCard, Visa, Discover, American Express or Diners Club card which has a sufficient balance to cover the charges. |
