The motion to Dismiss the case was denied as the pay advice and earning report filed by the Debtors constituted sufficient “other evidence of payment.” Where some payment information is filed within the 521(i) 45-day period, a determination needs to be made as to whether it constitutes “other evidence of payment” under 521(a). In such a situation, if the trustee or a party-in-interest does not request a dismissal order within 30 days after the 45-day period, the information will be viewed as sufficient and not having triggered the automatic dismissal provisions.
