- Can motions filed in contested matters be served electronically?
Motions filed in non-contested matters may be filed and served electronically in accordance with Bankruptcy Rule 9013. Motions filed in contested matters must be served in accordance with Bankruptcy Rule 9014(b), Bankruptcy Rule 7004, and Fed.R.Civ.P. 4. These rules require contested matter motions to be treated like complaints for purposes of service. There currently is no authority to effect service of contested motions electronically. That means that notwithstanding the automatic service of notice of motions on ECF participants through the Court's ECF system that occurs when a motion is filed, if that motion is filed in what would be deemed a contested matter, the movant must mail notice of the motion to those parties entitled to notice. All subsequent pleadings may be filed and served electronically in accordance with Bankruptcy Rule 9014(b) and Fed.R.Civ.P. 5(b) (as amended, permitting service through the court's transmission facilities). For examples of what types of motions are required to be served by mail in accordance with Bankruptcy Rule 9014(b), see the Advisory Committee Note to that rule.

Regarding Rochester Default Motion practice: Do I
still need to file opposition and provide the "paper" Chamber's copy of
opposition with the Court by Friday at 4:30?
Yes. Electronically filed opposition must be entered in the case and the Chamber's paper copy of the opposition must be received by 4:30 p.m. on the Friday before the calendar date. If there is a Monday or Tuesday holiday, the paper opposition must be filed by Thursday at 4:30 p.m. If both the electronic and paper opposition are not filed/received timely, the motion will not be put on the Court's motion calendar.

When I use ECF/Pacer to look up claims in a case, the system does not list all of the claims that were filed.
When searching for claims, CM automatically defaults to a search range that covers only the period from 1/1/1990 to the present date. You must change the 'From' date, to enable CM to search farther back in the case history. This change was made due to feedback received from Attorneys attending our CM/ECF Training Classes.

Instead of clicking 'Pay Now' or 'Continue Filing' when
e-filing a document requiring a fee, I closed the payment screen. How
can I get it back?
Go to the Utilities option on your menu bar. Under 'Your Account', select 'Internet Payments Due.' The payment screen will appear and you can complete the transaction.

If the debtor is the defendant in an Adversary Proceeding, do I enter the defendant's attorney when filing the complaint?
No. You should serve the debtor and the debtor's attorney, but the defendant's attorney is not added to the Adversary Proceeding case until the time of answer.

How does one obtain a certified copy of an order?
Requests for certified copies can be made in person at the intake counter or in writing through the U.S. mail, and will be provided in paper form. Payment must be made at the time of the request. Please see the Bankruptcy Fee Schedule or the Bankruptcy Fee Compendium for fee information.

When using my 'one free look' in email, I see two hyperlinks. What's the difference?
The link nearest the top of the page is a link to the case docket. Clicking on that link will cause the PACER login screen to appear, and you will be charged for what follows. Further down the page there will be a hyperlink to the document itself. Clicking on this link will open the document without charge (thus the 'one free look'). As you will only get 'one free look', you may wish to save or print the document.
